British Airways Executive Club Private Sale: 28 April - 13 May 2018
1. The Promotion
A. This Promotion (as defined below) is promoted by Value Retail Management (Bicester Village) Limited of Management Suite, Bicester Village, 50 Pingle Drive, Bicester, OX26 6WD (the “Promoter”) and is operated in conjunction with the Participating Boutiques (defined below) at Bicester Village.
B. This Promotion is available to participants from and including 28 April to 13 May 2018 (the “Promotion Period”).
C. This Promotion is only available at Bicester Village during the Promotion Period. For the avoidance of doubt, the Promotion is not redeemable at Suzhou Village or at any other European Village, namely Kildare Village, Fidenza Village, La Vallee Village, Maasmechelen Village, La Roca Village, Las Rozas Village, Ingolstadt Village or Wertheim Village.
D. This promotion (the “Promotion”) is subject to eligibility criteria (detailed in Clause 2) and comprises the Promotional Offers (detailed in Clause 3).
2. Eligibility criteria
A. To be eligible for the Promotion, participants must register their name and valid email address at BicesterVillage.com/ba-privatesale. Registration and the Promotion is only available to British Airways Executive Club members (the “Eligible Registration”).
B. Once a participant completes an Eligible Registration, the participant will receive a Private Sale invitation email (the “Private Sale Invitation”). The participant must retain and present the Private Sale Invitation (in accordance with the terms below) to access the Promotional Offer.
3. The “Promotional Offer”
The Promotional Offer comprises, where applicable:
A. Promotional discount
i. To receive discounts of up to an additional 20% (twenty percent) off the already reduced outlet prices (the “Discount”) on selected lines, British Airways Executive Club members must present a copy of their Private Sale Invitation, at boutiques participating in this Promotion at Bicester Village (the “Participating Boutiques”). Participants are advised that not all boutiques at Bicester Village are participating in the Promotion. ii. For a list of the Participating Boutiques and for any further exclusions within those Participating Boutiques, please see www.bicestervillage.com/participating-boutiques. iii. For the avoidance of doubt, a participant is not entitled to receive the Discount at any time before the commencement of or after the expiration of the Promotion Period.
B. Avios
i. Any British Airways Executive Club members who present their: (i) Private Sale Invitation; (ii) British Airways Executive Club; and (iii) receipts for goods (including food and beverages but excluding gift cards) purchased during the Promotion Period (the “Qualifying Purchases”), to the Bicester Village Visitor Centre or Information Hub shall be entitled to receive a thousand (1000) Avios with a minimum spend of five hundred (£500) pounds, or five (5) Avios for every four (£4) pounds spent, if you spend less than £500 on Qualifying Purchases ii. Claims for the Bonus Avios may only be made on the date the Qualifying Purchases are made. No retroactive claims will be permitted in connection with the Avios. iii. The Avios may only be redeemed once per participant.
4. General
A. The right to benefit from this Promotion, the Private Sale Invitation and the Promotional Offer is personal to the recipient of the Private Sale Invitation and cannot be transferred.
B. The Private Sale Invitation may not be copied, reproduced or distributed in any form, and must not be used by a person other than the original recipient.
C. The Private Sale Invitation cannot be used for prior purchases.
D. The Private Sale Invitation cannot be used for the purchase of gift vouchers at Bicester Village.
E. This Promotion, the Private Sale Invitation and the Promotional Offer may not be used in conjunction with any other special offer, coupon, voucher or other offer available in Bicester Village during the Promotion Period.
F. The benefits granted by this Promotion, the Private Sale Invitation and the Promotional Offer have no cash value and cannot be exchanged for cash.
G. The Promotion is subject to the eligibility criteria and exclusions provided above.
H. The Promoter reserves the right to amend, withdraw or cancel the Private Sale Invitation, this Promotion and/or the Promotional Offer for any reason, at any time, without giving prior notice.
I. Participants acknowledge and agree that: (i) The Promoter, its related companies and the owners of Bicester Village are not responsible for the prices at which any boutique at Bicester Village advertises or sells goods from time to time; (ii) the Private Sale Invitation does not create a contractual relationship between the Promoter, its related companies and the owners of Bicester Village and the participant in relation to the Discount or otherwise; (iii) the Promoter, its related companies and the owners of Bicester Village make no warranties regarding the goods (including without limitation the quality thereof) which the participant may obtain from the boutiques at Bicester Village; (iv) the participants shall have no right, and waives his/her ability to make any claim against the Promoter, its related companies and the owners of Bicester Village in the event that a Participating Boutique at Bicester Village fails to honour the Discount purported to be made available by this Promotion in whole or in part, and a participant’s only remedy in such a situation is the making of a claim for redress to the relevant Participating Boutique; and (v) nothing in these terms and conditions shall exclude or limit the Promoter’s liability for death or personal injury from its negligence or that of its employees or officers.
J. The Promoter will not be liable to participants for any financial loss arising out of refusal, cancellation or withdrawal of the Promotion and/or Promotional Offer, or any failure or inability of the participant to take advantage of this Promotion and the Promotional Offer.
K. The Promoter will not be liable for any technological failure, malfunction or problem(s) with the registration page.
L. The Promoter will not be liable for any failure of receipt of the Private Sale Invitation.
M. Participants’ registration for the Private Sale Invitation and/or use of the Private Sale Invitation and/or use of this Promotion and Promotional Offer indicates their agreement to be bound by these terms and conditions, and their acceptance of the Promoter’s Privilege privacy policy and terms and conditions found at www.bicestervillage.com/privilege-terms-conditions and www.bicestervillage.com/privilege-policy-notice.
N. By participating in the Promotion, participants agree to the use and disclosure of their personal data by the Promoter and its affiliates for all purposes reasonably necessary in connection with the Promotion and for all related marketing purposes. Participants are entitled, on written request to the Promoter, to access their personal data and to have any incomplete, inaccurate or misleading data amended or erased.
O. The Promoter reserves the right to amend these terms and conditions, at any time, without prior notice.
P. These terms and conditions shall be governed by English Law and participants submit to the exclusive jurisdiction of the English courts.
